Fox news reported this morning that American Airlines has banned all tipping of skycaps at Logan Airport in Boston. Apparently, this is in response to a
lawsuit the skycaps have against the airline concerning tipping. If American gets away with this, it could be only the beginning of a huge war between
tip-earners and employers. They start banning tipping and watch the quality of service go way down. I had a relative just come back from Australia, and she
said the service was horrendous because there is no tipping.

It's called retaliation.
RETALIATION UNDER THE FAIR LABOR STANDARDS ACTThe Fair Labor Standards Act prohibits retaliation by employers against employees for asserting rights under the FLSA in violation of Section 15(a)(3) of the Act, which provides: Prohibited acts; Prima facie evidence (a) After the expiration of one hundred and twenty days from the date of enactment of this Act [enacted June 25, 1938], it shall be unlawful
for any person -
Any adverse employment action is a violation of the above anti-retaliation provision if the proximate or motivating reason is the employee's exercise of his or her rights under the Act. These prohibitions were designed to permit employees to feel free to approach officials with grievances and to enhance compliance with the substantive provisions of the FLSA. Even if an employer's wage and hour policies do not violate the Act, it can be held liable for retaliation against an employee who merely believes the employer's wage and hour policies violate the Act and complains.

Skycaps were in the top ten for the most overpaid jobs. I was pissed dealers didn't make it. Maybe we don't have such a great gig. It started out that i just had to give them a few bucks and everything was fine. The passenger saved the hassle of standing in line and could be checked in at the curb. The company could help people quicker and help out with those long check in lines. The last time I flew I was charged $2.00 per bag tip NOT included. This is what I think happened: The airlines have been struggling for quite awhile so they have been looking to tap any sources of revenue possible. Charge for food, fuel surcharge, ticket change fees, and skycaps. These skycaps are probably union and they get paid well I would guess. With the tip money they might be of the charts. The airlines finally figured this out and they want to pull a Steve Wynn type of shakedown. What took them so long?? The skycaps provide a valuable service but the company should be able to define if their employees are allowed to accept tips while on the job or not. I wonder if Steve Wynn could just ban tips for dealers at the Wynn entirely. After he starves them all out he could hire the next best of the best. |

Does anybody know if Wynn can ban tipping while under union negotiations? I thought the status quo had to be maintained after the dealers voted the union in.

Tipping the Dealers at either The Wynn or Caesars Palace can NOT be banned because of their "status quo". The banning of tips at either casino would
be a "unilateral change" and would be in direct violation of Federal Law as outlined in the National Labor Relations Act.
BUT, any other casino where the dealers are NOT working under a Collective Bargaining Agreement or who are NOT protected by "status quo" could ban tipping. Throughout all of my years in the casino business I have many times heard the dealers say, "What more can they do to us now anyway?" Want a clue?

I wouldn't say that the service in L.V. is horrendous but I think the whole tip thing has gotten out of control. We have the people who give out the paychecks with the tip jar. I've seen people who work at Subway, ice cream shops, the seamstress, the bathroom guy, have tip jars. I like the fact that you can compensate them on their performance or lack there of. On the other hand it can be a real pain in the ass. What do you tip the seamstress or the ice cream girl?? Will the bathroom guy make life tough on me the next time I take a dump if he isn't compensated? In some cases it is extortion. Maybe people can just include this in the price and i can decide if the product or service is worth it. This way the owners will have to compensate their workers based on their worth. I've been to restaurants in Europe where they include the tip, and the service was weak so that could be the result of such an action. I've had plenty of nights where I made over $500 and paid little to no tax and I loved it. But this has kept pretty talented people in some really mundane jobs because they were turned into a whore in one way or another. They didn't bother to go to law school or medical school or pursue other aspirations because they just couldn't deal with that initial loss of income. If casinos had to pay straight salary to dealers and tipping were not allowed there would be consequences. $5 and maybe even $10 Black jack would be history. For poker they could charge by time played which they do at high limit games at the Commerce Club. |
