Florida Dealers Going For THeir Own? |

Hello,
Looking at some advertisements for the Indians in Florida looking for over 3000 Dealers, inquiring minds have to wonder, will they pool the tips or go for their own? Anyone out there have a clue? cheers, patrick |

Does it matter what they start out doing? Let me tell you something, when it comes to the laws on tips, Florida has the worst interpretation of tip pooling of
any state in this country. A judge in Florida ruled that employers can include anyone in their tip pool as long as they have included them in their tip pool.
The judge suggested that because federal laws state that nothing is to be construed to prohibit the pooling of tip among employees who customarily and
regularly receive tips, employer may mandate tip pooling among who ever they want. He basically ruled that those who are included in a tip pool are receiving
tips customarily and regularly and as such federal laws allow the employer to include them in the pool.

Federal Laws still apply on the reservations. The reservations don't like to admit it. Just look at the court cases that they lose whenever they say they
aren't bound by them.
