Horn hi, that's just propaganda you are repeating. The lawsuit wasn't brought under California's labor laws. It was brought under the state's Unfair Competition Law. I guess we need to find out what our state laws are concerning unfair competition and see if this case has set a presedent here in Nevada.

Here is an interesting observation.

Why did the Judge deceptively state that California labor law prohibits managers and supervisors from sharing in employee tips and totally ignore the fact that state labor laws prohibit employers from collecting tips. Here is California's labor law concerning tips and gratuities?

No employer or agent shall collect, take, or receive any gratuity or a part thereof that is paid, given to, or left for an employee by a patron, or deduct any amount from wages due an employee on account of a gratuity, or require an employee to credit the amount, or any part thereof, of a gratuity against and as a part of the wages due the employee from the employer. Every gratuity is hereby declared to be the sole property of the employee or employees to whom it was paid, given, or left for. An employer that permits patrons to pay gratuities by credit card shall pay the employees the full amount of the gratuity that the patron indicated on the credit card slip, without any deductions for any credit card payment processing fees or costs that may be charged to the employer by the credit card company. Payment of gratuities made by patrons using credit cards shall be made to the employees not later than the next regular payday following the date the patron authorized the credit card payment.

Please note that the law does not contain the words managers or supervisors. Please also not that the law says absolutely nothing about sharing tips.

Why do judges have to be deceptive and make up lies every time there is a case concerning employer mandated tip pools?

I believe she was simply attempting to cover up the fact that several judges in California have intentionally misinterpretted California's labor laws?

Isn't Starbucks collecting tips with those jars they put out? Aren't tip jars basically the same thing as tip pools?

You see, there are two common denominators with tip jars and employer mandated tip pools. One is that they both illegally collect the tips customer's present. The other is that in both cases employers are illegally controlling the customer's tip. This case should set a presedent in every state in this country. If only the judge would have had the courage to speak the truth about the whole issue.

Some more propaganda the media is spreading.

California's tip pooling law says that gratuities meant for hourly workers can't be taken by an employer or its "agents" and Judge Cowett found that Starbucks supervisors were "agents."

To start with, California does not have any tip pooling laws. Secondly, grratuities should be meant for who ever the customer wants them meant for.

It's amazing the way the media will attempt to deceive the public. Please note that California's laws on tip do not even mention tip pooling and yet the media will lie to the public and suggest that California has tip pooling laws. Please also note how the media will deceptively suggest that tips are intended for all hourly employees without even asking the public who their tips are intended for. The public is deceptively being led to believe that the tips they present will legally be viewed as that which is intended for hourly employees and that customers will have no say in the matter.

Are the tips you present as a consumer intended for all hourly employees. or instead, are you tipping individuals of your choosing?

There is a huge conspiracy in America to deceive the public into a false perception that they do not have the right to determine who their tip is intended for. Judges, government officials and the media are attempting to deceive the American consumer into believing the consumers do not have a constitutional right to decide for themselves who their tips are bestowed upon.

Why would such people want to deceive the public into a falce percetion that they have no right to determine who their tip is intended for? So business owners can control the customer's tip to the interests of the business.

Starbucks was confiscating 100's of millions of dollars in tips to pay it's supervisors. Other businessses are confiscating billions of dollars so that they can use them to pay for busboys, pit clerks, hostesses, kitchen workers, security guards and many other workers who don't typically recieve tips direcly form the customer. Employer mandated tip pooling is simply an act by employers to confiscate their tipped employee's tips so that the business can utilize the money to pay workers who do not typically receive much in the way of tip income. It's become an epidemic across our country.
